What damage is DB AutoZug GmbH liable for?
DB AutoZug GmbH is liable for personal injury and property damage suffered by passengers in accordance with the statutory regulations, in particular as specified in German liability law, the regulations concerning carriage by rail (EVO), the German Commercial Code (HGB) and, on international routes, pursuant to the Convention concerning the international carriage of passengers and luggage by rail (ER/CIV).
- The most important effects of the statutory liability regulations which are currently in force are as follows:
There are limits to the liability payable for personal injury and property damage and for damage owing to any delays in releasing the vehicles. In case of damage to the vehicles, DB AutoZug GmbH is liable only for the direct material damage (damage to the vehicle itself), up to a maximum sum of EUR 20,400 on national routes and a maximum of 8,000 accounting units on international routes (equivalent to approx. EUR 10,200) per vehicle.
Reimbursement of other costs (such as car rental, loss of use, assessor, lawyer’s fees) is either limited or ruled out. In case of loss or damage to luggage, bicycles or other objects left in the vehicle, DB AutoZug GmbH’s liability for damage is limited to EUR 1,280 on national and international routes.
DB AutoZug GmbH is not liable for damage to any luggage etc. which is stowed outside the vehicle.
Our liability is ruled out by law in case of damage due to unavoidable incidents (e.g. vandalism, theft, falling rocks, weather conditions, industrial waste gas). Any specified limits to the extent and/or level of liability do not apply if the damage is due to intent or gross negligence on the part of DB AutoZug GmbH.
If you establish that your vehicle has been damaged during the transport, please advise the loading crew when your vehicle is unloaded and have a damage report drawn up free of charge. Any damage which is not immediately apparent must be reported to the DB Autozug terminal within one week of unloading in the case of routes inside Germany and within three days in the case of international European routes.
